Terms of Service

1. Company Information

Caroto is an application operated by SmartWagon IKE, a private company established in Greece in 2024, under the laws of the Hellenic Republic (“SmartWagon”, “Company”, “we”).

2. Acceptance of Terms

By downloading, registering, accessing, or using the Caroto application (“App”), you confirm that you have read, understood, and agree to be legally bound by these Terms, the Privacy Policy, and all applicable laws.

If you do not agree, you must not use the App.

3. Eligibility

You must be at least 18 years old and hold a valid driving license to use Caroto. By using the App, you represent and warrant that you meet these requirements.

4. Purpose of Caroto

Caroto provides:

• Navigation and driving-related insights
• Driving behavior analytics and safety scoring
• Reward mechanisms for safe driving (“Caroto” points)
• Local shopping and product discovery
• Route planning for multi-stop shopping trips
• Informational and motivational content

Caroto does not provide driving instructions, safety guarantees, or legal advice.

5. No Control — User Responsibility

You acknowledge that:

• You are solely responsible for your driving behavior at all times
• You must always comply with traffic laws and regulations
• The App does not replace your judgment, attention, or responsibility as a driver
• SmartWagon does not control roads, vehicles, traffic, weather, GPS accuracy, or third-party data
• You must not interact with the App while driving unless safely parked

6. Account & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. SmartWagon is not liable for any loss arising from unauthorized access to your account.

7. Payments & Rewards

• Payments are processed securely through Stripe. SmartWagon does not store your payment card details.
• “Caroto” reward points are virtual, have no cash value, and cannot be exchanged for money.
• Reward points may be used to redeem products or discounts within the App, subject to availability.
• SmartWagon reserves the right to modify, suspend, or terminate the rewards program at any time.
• All purchases are final unless otherwise stated by the vendor or required by applicable law.

8. Limitation of Liability

To the maximum extent permitted by Greek and EU law, SmartWagon IKE shall not be liable for any damages, including but not limited to:

• Accidents, injuries, or death
• Property damage
• Financial or business losses
• Incorrect navigation, route suggestions, or data inaccuracies
• Loss of reward points or transaction failures
• Service interruptions or downtime

Use of Caroto is entirely at your own risk.

9. Disclaimer

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Assumption of Risk

Driving is inherently risky. By using Caroto, you explicitly acknowledge and accept all risks associated with driving and mobility activities. The safety scores and analytics provided are informational only and do not guarantee safe driving conditions.

11. Prohibited Uses

You agree not to:

• Use the App while operating a vehicle (except as a passive passenger)
• Attempt to manipulate driving scores, rewards, or analytics
• Reverse-engineer, decompile, or tamper with the App
• Use the App for any unlawful purpose
• Submit fraudulent receipts or false transaction information
• Create multiple accounts to abuse the rewards system

12. Indemnification

You agree to indemnify and hold harmless SmartWagon IKE, its officers, directors, and employees from any claims arising from:

• Your use of the App
• Violation of these Terms
• Violation of any law or third-party rights
• Any content you submit through the App

13. Account Deletion

You may delete your account at any time through the App's Settings screen. Upon deletion, all personal data is permanently erased in accordance with our Privacy Policy. You may also request deletion by contacting privacy@smartwagon.gr.

14. Termination

SmartWagon may suspend or terminate your access to Caroto at any time, with or without cause, without prior notice and without liability. Upon termination, your right to use the App ceases immediately.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of Greece. The courts of Greece have exclusive jurisdiction over any disputes arising from or relating to these Terms or your use of the App.
